RELEASE OF LIABILITY AND WAIVER AGREEMENT

I, the undersigned, hereby acknowledge and agree to the following terms and conditions related to my use of the hot springs facilities and participation in activities provided by San Juan Style LLC, DBA The Hoosier (hereinafter referred to as “Hoosier Hot Springs"). This Release of Liability and Waiver is ruled by the laws of the State of New Mexico.

Assumption of Risks: I understand and acknowledge that the use of Hoosier Hot Springs facilities involves inherent risks, including but not limited to slipping, falling, personal injury, property damage, or death that may result from my participation. I voluntarily assume all risks associated with my participation. Hoosier Hot Springs assumes no liability for the loss of or damage to personal property.

Release of Liability: I hereby release, waive, and discharge Hoosier Hot Springs, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, or causes of action arising out of my use of the facilities and participation in activities provided by  Hoosier Hot Springs to the fullest extent permitted by law.

Indemnification: I agree to indemnify and hold harmless Hoosier Hot Springs from any loss, liability, damage, or costs, including court costs and attorney's fees, that may arise from my use of the facilities or participation in activities.

Alcohol and other Intoxicants: The consumption of alcohol, marijuana or other intoxicants is prohibited, either before or during the use of Hoosier Hot Springs facilities. Alcohol, or other intoxicants may increase the effect of potential health hazards, impair judgment, and/or cause light-headedness or loss of consciousness.

Medical Health: Hoosier Hot Springs mineral waters may present special health considerations for people with chronic conditions such as heart, respiratory, or circulatory conditions, pregnant women, and diabetics. Also, certain medications may intensify the geothermal water’s effect and present unexpected health hazards. I hereby certify that I am in good physical health and have the ability to safely engage in the activities provided at Hoosier Hot Springs.

Treatment Authorization: In the event of an emergency, I authorize the Company to seek and consent to any necessary medical treatment for me.

I have read this release of liability and waiver agreement, fully understand its terms, and voluntarily agree to be bound by it. I agree that if any portion of this Agreement is found to be void or unenforceable under the laws of The State of New Mexico, the remaining portions shall remain in full force and effect.
